  • Retained Right of Residence

    If your situation has changed since you have been in the UK by either, a separation from your EEA National, the EEA National has died or they have left the UK, you may still be able to make an application under the rules on Retained Rights.

     

    Even if the relationship between you and your EEA National Family member has ended, if you previously held an EEA Family permit or residence card, you may still be able to meet the requirements for a permanent residence card on the basis of your retained rights in certain situations;

     

    • Divorce or Dissolution of marriage: (Parties must have been married for three years and at least one of these years was spent in the UK together.
    • As a victim of domestic violence from the EEA National: You must provide evidence of the violence that was suffered such as, medical report, police conviction or caution, a court conviction or a non-molestation or protection order against the EEA National
    • On the basis that you (the non EEA National) has custody of a child to the marriage
    • Retention of Rights of the basis of access to a child of the marriage (who is in the care of the EEA National.
    • Death of EEA Family Member: Must have been residing in the UK as a Family Member of EEA National for at least one year before the death
    • Upon the EEA National leaving the UK.

     

    However, there are certain requirements that you must meet to be eligible, these will vary depending upon which grounds you are claiming retained rights. 

     

    Another benefit of obtaining permanent residence in the UK is that after holding this status for one year, you will be able to apply for naturalisation as a British Citizen.
